Terms of service

1. Who we are

DriftCaught Ltd (DriftCaught) provides continuous evaluation of AI features as a subscription service. Our contact address is hello@driftcaught.com. We reply within 24 hours on business days.

2. What we sell

An eval baseline, sold once, and monthly plans that rerun and maintain the suite the baseline produced. A feature is one AI capability with its own prompt or pipeline and its own golden dataset.

Prices are in US dollars and exclude any tax we are required to add. They are the same for every customer and are published on the plan pages.

3. What we commit to

These six commitments apply to every plan and are the complete list.

1. First eval baseline within 10 business days of access.
2. Every tracked provider update triggers a rerun within 2 business days of the provider's announcement.
3. Every flagged prompt or retrieval change is evaluated before it ships, within the plan's turnaround.
4. Monthly drift report by the 5th business day.
5. Judge recalibrated against human verdicts at least monthly.
6. If a regression above the agreed threshold reaches production on a change we marked as passed, the next month is free.

Nothing said in an email, on a call or elsewhere on this site adds a commitment beyond these six. Where the sixth applies, the remedy is one free month of the plan in force, which is the sole remedy for that event.

4. What we cannot do

We cannot make a model deterministic or guarantee its outputs. We measure against an agreed dataset and thresholds and report what changed. We do not train or fine-tune models, and we do not replace human review for policy or legal decisions. Coverage is bounded by the dataset and the plan.

We publish no measurement of any model as our own. The model change log on this site restates announcements made by model providers, with their sources.

5. What we need from you

• Sample inputs and outputs, the prompt or pipeline, and a way to run it.
• A domain expert who can grade ambiguous cases. This cannot be delegated to us.
• Notice when you change a prompt, a retrieval step or a model id.
• Agreement on the thresholds that gate a release.

Turnaround commitments start when we have access. A commitment we cannot meet because access was withheld does not carry the remedy in clause 3.

6. Your data

Your inputs, outputs, datasets, scores and reports are yours. We use them to run the service and for nothing else. We do not use them to train a model, we do not share them with another customer, and we do not publish them. The suite runs in your stack, so you keep it if you leave.

We delete working copies within 30 days of the end of a plan on request. Provider terms apply to any model call your pipeline makes; we make none of our own on your behalf outside the runs you have authorised.

7. Payment

The baseline is invoiced on order. Monthly plans are invoiced monthly in advance. Invoices are payable within 14 days. There is no hourly rate and no usage meter.

8. Term and cancellation

Monthly. Cancel with 30 days' notice. No setup fee beyond the baseline. The baseline fee is credited to the first month of any plan started within 60 days.

We may end a plan with the same 30 days' notice. If we do, we refund any period paid for and not delivered.

9. Liability

Our total liability under a plan in any twelve-month period is limited to the fees paid for that plan in that period. We are not liable for the behaviour of a model, for a provider's changes, or for a decision you take on the basis of a report. The limits in clause 4 are part of what you are agreeing to.

10. Changes to these terms

We give 30 days' notice by email before a change takes effect for an existing plan. A price change never applies to a period already invoiced.

11. Law

These terms are governed by the law of Cyprus, and the courts of Cyprus have jurisdiction.
